Important Information - Settlement with Consumer Financial Protection Bureau and certain State Attorneys General
Campus Student Funding, LLC ("CSF") is the holder of private student loans that individual students received to attend an Everest, Heald or WyoTech College (Corinthian Colleges campuses). Such loans that had outstanding balances as of March 31, 2017 which are currently held by CSF are referred to as “Eligible Loans.” CSF, the Consumer Financial Protection Bureau and a number of State Attorneys General reached a settlement (the “Settlement”) regarding alleged unlawful student lending practices of Corinthian Colleges and, indirectly, CSF as purchaser of certain student loans originated through Corinthian Colleges. The Settlement was approved by the U.S. Federal District Court and applicable State Attorneys General. CSF neither admitted nor denied liability in connection with the Settlement.
The Settlement requires CSF to provide loan relief for all Eligible Loans, including partial or full loan discharge. Relief is available only to obligors (borrowers, co-signers and guarantors) of Eligible Loans that had unpaid balances as of March 31, 2017. Loans held or owned by anyone other than CSF, including government student loans and private student loans not held by CSF, are not covered by the Settlement. (Please refer any questions related to loans not covered by this Settlement to the servicers of such loans. The Settlement is nationwide and is not limited to particular states. If you are eligible for relief under the Settlement, you were or are to be provided with a written notice, to be sent or already sent to your current mailing address in our or our servicer’s records (your “Record Address”). This notice includes the amount of debt discharged and a description of other important terms of the Settlement. If you are eligible for loan relief on an Eligible Loan, you will not need to apply for relief provided by the Settlement but you should keep such notice in your records.
IRS Form 1099-C:
Federal law requires the issuance of a 1099-C form to any borrower receiving a discharge of principal indebtedness of $600 or more. If you have received a 1099-C form from Aequitas Holdings (on behalf of Campus Student Funding), it does not necessarily mean that you are required to pay tax on the amount of discharge from indebtedness income shown on the form. Depending on your individual facts and circumstances, exceptions and defenses could be available to you. You may need to file a form with the IRS to claim an exception. NOTE: All notices and other communications to borrowers of Eligible Loans, including notices of relief under the Settlement and checks for refund amounts required by the Settlement, will be directed via regular U.S. Mail to your Record Address. Refunds on Eligible Loans are subject to processing times.
